Le législateur n’est pas très rapide pour faire évoluer les lois, d’abord la société, le droit ensuite, c’est logique. il faut s’assurer que l’évolution en question n’est pas juste une lubie, un phénomène de mode, s’assurer de sa continuité donc, de sa faisabilité (moralité? justice? constitutionnalité…)… Et de regarder aussi ce qui se pratique dans les pays voisins.
Et oui les évolutions sont inhérentes aux êtres humains bien entendu. C’est ce qui fait notre charme…
Je conseille à tous ceux que ces questions interpellent, la lecture des écrits de l’anthropologue Claude Levi-Strauss, et notamment d’un petit ouvrage intitulé « l’anthropologie face aux problèmes du monde moderne », aux éditions du Seuil.
L’étude des structures sociales et de parenté de sociétés millénaires nous apporte un éclairage sur nos propres sociétés et nous permet de relativiser énormément. Ce qui nous parait naturel, et dans l’ordre des choses, n’est qu’une somme de « contraintes et d’habitudes mentales propres à notre culture ».
Dans beaucoup de sociétés, les règles de parentalité s’affranchissent totalement des liens biologiques. (Ainsi, le père légal n’est pas toujours le géniteur). Et ces sociétés fonctionnent très bien ainsi.
En conclusion, les anthropologues prodiguent des conseils de libéralisme et de prudence. Chaque société est capable d’inventer et de mettre en place les structures familiales et sociales qui lui conviennent, et de faire évoluer celles-ci en fonction de la logique qui l’anime. Notre société change, à tous points de vue, et ses structures de parentalité, de fait, ont énormément évolué depuis quelques décennies. Le législateur se doit d’accompagner cette évolution.
Le mariage pour les conjoints de même sexe ouvrirait les portes de changements anthropologiques majeurs : ce changement du droit du mariage serait changé, mais toutes les règles de la filiation : les enfants n’auraient plus le droit d’avoir un père et une mère. C’est pourtant le premier des droits de l’homme.
